Rental Agreement
This Rental Agreement (the "Agreement") is entered into on the date you book your order, by and between:
PARTIES:
- THE WILDFLOWER DENVER LLC (hereinafter referred to as the "Company")
- RENTER NAME: (hereinafter referred to as the "Renter")
Thank you for choosing The Wildflower Denver LLC for your rental needs. We are excited to provide you with our services. By completing payment for any order, you are entering into a formal Agreement. Both parties agree to the following
terms:
1. PAYMENT AND CANCELLATION:
1.1. A 50% payment is due upfront to reserve the items for your event. The remaining 50% is due 30 days from the event date. For orders within 30 days, full payment is due at time of booking.
1.2. Cancellation Policy:
- Up to 90 days before the event: 100% refund.
- 90 to 30 days before the event: 50% refund of the total rental fees.
- Within 30 days of the event: The rental fee will be non-refundable, but delivery fees will be refunded.
2. CARE OF RENTED ITEMS:
2.1. We kindly request that you take good care of the rented items during the rental period.
2.2. Significant damage or loss above 1% of the rented quantity may result in additional charges to repair or replace the items.
2.3. A refundable security deposit may be required to cover any damages or losses, as detailed separately if applicable.
3. CONDITION OF RENTED ITEMS:
3.1. Rented items are provided on an "as-is" basis. We make no warranties, expressed or implied, regarding the condition, suitability, or fitness for a particular purpose of the rented items.
4. DELIVERY:
4.1. Delivery Options: We offer a variety of delivery, setup, and pickup services based on your selected package:
Local Delivery & Pick Up: Includes delivery and pickup within 150 feet of your driveway. This service does not cover stairs, elevators, or the setup/breakdown of items such as tables, chairs, linens, or the unpacking/packing of dishes. Certain items, such as champagne walls and dance floors, require our setup and are included in this service.
Local Delivery & Pick Up plus Setup & Breakdown: Includes delivery and pickup within 150 feet of your driveway as well as our full setup of rental items. This includes the placement of tables, chairs, linens, and unpacking of dishes, along with breakdown and packing of items after the event. This service does not include the use of stairs or elevators.
4.2. Customer Pickup and Return: Customers may choose the Free Customer Pickup and Return option. To ensure smooth service, please arrive within 1 hour of your scheduled pickup time and bring a vehicle of appropriate size. You are also required to have proper straps or securing equipment to safely transport the rental items.
4.3. Labor Charges for Extra Work: A $50 per hour labor fee will be charged if items are not properly broken down, packed, or if additional labor is required to complete the setup or pickup beyond the agreed-upon scope of work.
4.4. Availability for Drop-Off and Pick-Up: Please ensure that someone is available to coordinate and assist with the drop-off and pickup of the rental items at the scheduled times. If you are unavailable at the time of delivery or pickup, additional charges may apply.
4.5. Scheduling for delivery and/or pickup will be arranged after the order is placed. We will confirm the details and provide a timeframe for your delivery and/or pickup to ensure smooth coordination.
5. LIABILITY:
5.1. While we want you to enjoy your event without any worries, we cannot be held responsible for any injuries, accidents, or damages that may occur during the rental period.
5.2. Please use the rented items responsibly and take necessary precautions to ensure safety.
6. DISPUTE RESOLUTION:
6.1. Any dispute arising out of or in connection with this Agreement shall be governed by and construed in accordance with the laws of the state of Colorado, without regard to its conflict of laws principles.
6.2. To the fullest extent permitted by law, you agree to waive your right to a jury trial in any legal proceedings arising from or related to this Agreement.
